A Tangled Web We Weave…

An inheritance dispute concerning a wife, a bigamous wife and a fiancee of the same man may seem a little far fetched it is not at all unusual to a contentious probate solicitor. Increasing numbers of family divisions and breakups mean more and more families have cause for concern when a Will is found to leave little or nothing to those expecting inheritance. In the case of EastEnders, Archie has left a tangled web of women behind him following his suspected murder on Christmas Day 2009.

One immediate question a suspected murder raises, apart from the obvious ‘who did it?’ is whether or not the murderer is named as a beneficiary under Archie’s Will. In the Square any number of suspects is likely, including those who received gifts under the will. The law prevents a person from benefitting from his wrongdoing and a person who kills another cannot then benefit from the deceased’s estate… trying to fast track your inheritance in this way is not smiled upon by the Courts…

Putting aside the murder suspect, it transpires that Archie was a wealthy man who leaves the whole of his residuary estate (approximately 3M) to his youngest daughter Roxy. His granddaughter is to receive 100,000 and interest when she reaches the age of 21. The other hopefuls, Archie’s wife, fiancee, eldest daughter and nephew leave with only a handful of personal belongings between them. But of course this is EastEnders and it turns out there is also an unknown son!

Potential Claims

Peggy
As Archie’s widow, Peggy would be able to make a claim under the Inheritance (Provision for Family and Dependants) Act 1975 (IPFDA) for reasonable financial provision as the will fails to adequately provide for her. However, their marriage was relatively short but Archie had only been with his fiancee Janine for a few weeks. In claims by spouses for reasonable provision the court will consider what is reasonable using similar principles to those used by a divorce court. The marriage was short and there were no children to look after and the court would consider what each party had brought into the marriage but nevertheless Peggy could have expected to receive substantial provision from the Will given that Archie was still her husband and their marriage, albeit turbulent, had not yet been ended by divorce.

The big question however was whether Peggy was actually married to Archie. If he had not divorced Glenda at the time of his marriage to Peggy the marriage would be void. This would have a significant impact on Peggy’s claim if it demoted her to a cohabite who can also claim under the IPFDA if they have lived together as husband and Wife for 2 years before death. Unlike a spousal claim a cohabite has to demonstrate that provision is necessary for his or her maintenance – after a much less generous measure. However, whether or not the marriage was a bigamous one, Peggy is entitled to claim as a spouse because she entered into the void marriage in good faith.

Glenda
The ex wife. Ex wives do have a right to claim under the IPFDA but only if reasonable provision has not been made for them. They are not entitled to the more generous provision available to spouses. Glenda has clearly had no contact with Archie for some time and is in no way financially dependant on him. Her children (although see below) are adults and it does not seem she has been receiving any financial help from Archie over the years. Glenda, in the circumstances, would have a difficult claim.

Janine
As the fiancee Janine’s position is very precarious as she only ‘lived’ with Archie for a matter of hours before he threw her out of the Queen Vic. There is no indication that Janine was being financially maintained by Archie and the fact he was still very much married to Peggy would have meant any eventual marriage was not immediately imminent. Janine would have no claim as a cohabite as she would not have lived as Husband and wife with the deceased for the necessary 2 year period.

Janine’s only possible claim would be as a person maintained by the deceased. However she would have to show that Archie had been making a substantial contribution towards her reasonable needs and given the time scale involved this seems highly improbable.

Ronnie
The eldest daughter, Ronnie made no secret of the fact she hated her father. As an adult child she is entitled to bring a claim but as with a cohabite she would have to show that it would be reasonable for her to have some provision for her maintenance. That aside seeing her sister Roxy inherit such a large sum may prompt Ronnie to challenge the will as being unjust. It is not uncommon in cases where children have been left unequal amounts in a will for the ‘offended’ child to believe they have a claim to a larger share. This is not correct and there is no requirement for children to be left equal shares of an estate. Ronnie has an independent income and was not being supported by her Father prior to his death and so is unlikely to succeed in any claim.

Roxy
It is unlikely Roxy will do anything to challenge her Father’s will, or assist others to challenge it either as she inherits the bulk of the fortune. Her daughter is also well provided for.

Unknown Son
We have no information about the son and do not know how old he is or where he is now. Children, illegitimate children, adopted children and children treated as a child of the family by the deceased can all bring claims under the IPFDA. However as with Ronnie the son would have to show he needed provision for his maintenance. It seems unlikely he would succeed in his claim as he has never attempted to contact Archie (we assume).

Unless of course Archie has been in secret contact with him and has been providing for him… ‘doof doof doof’ and cue the music!…

Concluding moments

As with any type of litigation, parties to probate and Will dispute litigation can incur significant costs if they cannot agree on an early settlement. It is important that a person making a Will remembers that although they are entitled to leave their estate to whoever they wish, they must be aware of the potential claims that could be made by family members who are excluded or only left ‘token’ gifts when more was expected or even promised to them. Resolving such disputes can be a lengthy process and it is unlikely we will see a resolution through the formal legal process on EastEnders. However, knowing the characters involved in the current story it is unlikely they will let matters rest as they are! Law and order in the Queen Vic is as unconventional (and unpredictable) as it comes…

The Texas Senate took another step in ensuring the state’s long term energy future by the passing of Bill 20 in 2006 and the Competitive Renewable Energy Zones it has created.

It might not be your first guess, but electricity Texas is a big producer of wind energy. Geography and meteorology produce optimal breezes and gales in the state’s northern regions. The United States Energy Information Administration notes that the state features over 2,000 wind turbines in West Texas. There are numerous more plans in the works to take advantage of the low population to high electricity potential areas of the state. Legendary oilman T. Boone Pickens has even expressed a desire to dot the land with those large, slowly turning fans. The great advantage of wind generated electricity, of course, is that it harnesses energy that would otherwise be wasted. The downside, at the moment, is that those wind rich regions are pretty far away from many of the population centers in Texas.

Senate Bill 20 was created to address this inefficiency with the creation of Competitive Renewable Energy Zones (CREZ). In order to encourage economic development, the Texas government is putting millions of dollars into development of electric stations and power lines. According to Companies and Markets, installed wind power capability will jump up to 21,664 megawatts by 2015, constituting a significant portion of Texas’ energy needs.

Everyone benefits from this kind of situation. The average energy consumer is able to make use of electricity generated by a clean source. Further, the increased supply of energy could even drive down the price per kilowatt hour. (Remember those supply and demand curves from school? The higher the supply, the lower the demand will be for any specific unit of energy.) The electricity providers benefit because they have a ready supply of power to sell to their customers and a new and improved grid through which to sell it.

Perhaps the best effect of this legislation is the jobs that all of this construction creates and will continue to create over the next several years. These building projects will help blue collar employees both in urban and rural areas of the state. The San Angelo Standard Times reported in January of 2010 that, while increased oil drilling was providing paychecks to hardworking families, the grants provided for CREZ building will directly create jobs in Sweetwater that otherwise may not have existed.

This partnership reflects the reality that will effect meaningful change when it comes to the revitalization of the electricity Texas infrastructure. A small investment of state money becomes, in time, a boon for the private firms looking to do business in Texas. The same principle worked when the federal government, encouraged by then President Eisenhower, built the Interstate Highway System. The project benefited individual, business and military interests, eventually leading to the blossoming of the suburbs and a sea change in American life. Once the additional transmission capacity is in place, those far flung regions will be able to flourish, in addition to providing some small measure of their energy. This is also yet another instance in which public and private concerns are working together for the common good, leading the way to a more efficient, cheaper and environmentally friendly future.

Signs and Symptoms

There are several types of psoriasis. We have Plaque psoriasis, Nail psoriasis, Scalp psoriasis, Guttate psoriasis, Inverse psoriasis, Pustular psoriasis, Erythrodermic psoriasis and Psoriatic arthritis. And the common of it’s the plaque psoriasis. The symptoms of psoriasis might defer contingent on what type a person has but may include one or a lot of the following:

*Red patches of skin, inflamed skin generally overlaid with silver colored scales is the common form of plaque psoriasis. These patches may be itchy and painful. The itch may occur anyplace in your body including your genitals. Some of the times these red patches crack and bleed.

*Psoriasis may also affect your fingernails and toenails. Discoloration and pitting of the nails can also be among the symptoms of nail psoriasis. This might causes the nails to loosen and will eventually detach from the nail bed. Nails may crumble in almost severe cases of nail psoriasis.

*Scalp psoriasis or psoriasis on the scalp may appear red. Itchy fields of the scalp might have silvery colored white scales. Flakes are noticeable in your hair or shoulders, particularly after scratching your scalp.

*Guttate psoriasis might affects people less than 30 years of age. Marked by small water-drop-shaped sores on your trunks, arms, legs and scalp.

*Inverse psoriasis is the kind that mainly affects the skin in your armpits, groin, under the breasts, and around the genitals. Inverse psoriasis is common the outsized people and it is worsened by friction and sweating.
Psoriasis isn’t an infectious disease. It’s caused primarily because of an individual s genetic structure. A primary reason why Psoriasis occurs in individuals is a trigger factor.

Stress

If a person is stressed, it can trigger Psoriasis. Flare-ups are most common and can be accompanied by itching sensation as well. Once Psoriasis occurs the person can feel excessively self-conscious and embarrassed, leading to more stress. If the condition is gift on the feet and hands, it can disable a person from performing daily chores.

Weather and climate

The combination of excessive cold away and the presence of indoor heating agents inside can trigger Psoriasis. Both conditions in combination dry out the skin and can make existing Psoriasis conditions worse. Winter vacations can also entail additional work around the house, which maybe curtailed because of Psoriasis. Illness during winter can debilitate the immunity of a person, making them more prone to Psoriasis. Being in the sun can dramatically help improve the condition.

Injuries on the skin

Skin injuries because of acupuncture, certain vaccinations, bruises, bites, chafing of skin, burns, scraping of skin, irritation from chemicals, shaving, excessive pressure over skin, tattoos, using adhesive tapes over the skin, cuts, sunburns, skin peeling treatments, scratching and rubbing of skin can all trigger Psoriasis. This specifies is referred to as Koebner effect.

Infections

Various infections can also be a trigger factor for growth of Psoriasis. Infections include strep throat, which triggers Guttate type of Psoriasis. Then, infections in the upper respiratory tract, HIV, skin boils etc. can also trigger Psoriasis. An infection of thrush can make a person susceptible to Inverse kind of Psoriasis.

Medications and drugs

Patients already sticking out from Psoriasis, tend to grow several flare-ups when they ingest Lithium. Medications intended to treat high blood pressure can also trigger Psoriasis. Medications such Inderal worsens existing symptoms of Psoriasis in 25 or 30% of Psoriasis patients.

Hormonal changes

Typically, once a person is beyond puberty, the overall hormonal concentrations cut down. Symptoms pertaining to Psoriasis show betterment during pregnancy when hormonal levels surge. However, once the kid is born, hormonal stages reduce, again triggering Psoriasis.

I justify such an attitude thusly: That item is very trendy. It will likely be out of style next year. I should just spend my money on something far less expensive if I’m just going to get a newer, trendier bag next year/season. Also, that bag will not match with everything, so I should instead spend far less money on getting two, or even three handbags so that I can switch it up.

Am I alone here? Sure, I dream of a day when I can spend more than $8 for a pair of jeans at the local thrift store (although I get a small thrill when I find a great deal there). I long for a time when I can get all new dishes that actually match, don’t have chips in them, and were not on sale at the time of our wedding 9 years ago. But I like to think that even if I was rolling in the dough, I would not spend $1200 on a stroller, $160 on a pair of baby shoes, or $125 on mascara.

Maybe it’s because right now I know where every single penny goes. I time bills and groceries and gas tank fill-ups around pay day. I check Craig’s List almost religiously. Maybe when things are tight, you are tight. At times it’s tough, but I feel good about it. I have a streak of hippie chick, the old “reduce, reuse, recycle”, less-is-more kind of attitude. (Ironically, that $400 bag was called “The Hippie Chic” bag. I don’t think a lot of actual hippie chicks are buying it.)

So here’s my breakdown of a few must-haves, and how much I paid for them.

::Baby Gear::
–Baby Trend Phantom Car Seat: rated #1 by Consumer Reports Magazine. Originally $110. I paid $45 to a girl from Craig’s List who got 3 car seats at baby showers.

–Baby Trend Sit ‘n Stand Stoller: $150. The first thing I ever bought brand new, and the most expensive. Bought when I had my 2nd baby so my 1st could easily get on and off, and it’s been worth every penny. Still using it regularly after5 years. I can load 4 kids on that thing!

–Fisher Price Soothing Sounds Bouncer: $8 at thrift store. Took it all apart, washed everything, and it was like brand new! This is one of the most used items when I have a baby around. I love bouncer seats.

–Graco Baby Swing: Free from a friend who never used hers. Gave it away for free because I never used it, either. Loved the bouncer over the swing.

–Peacock Tote bag: $18, brand new, on sale. It was so super cute and fit all my baby gear in it: diapers, wipes, blankie, toys, wallet, keys, cell phone. Then I got done having to carry a diaper bag and did not feel the least bit bad about donating it to the thrift store.

::Mommy Gear::
–Max Factor 2000 Calorie Mascara: $6. I have done makeup for beauty pageants, plays, ballets, and proms. If there’s a drug-store mascara out there, I have tried it. I’ve even used the fancy department store $60 kind. There is none, in my opinion, that is as fantastic as 2000 Calorie.

–Acorn Slippers $40. Yes, forty bucks is a lot to spend on slippers. This is my one big spend item for winter. My feet are cold from the end of September to the beginning of May, so I wear my slippers constantly. I don’t like floppy things that I have to shuffle around in. These are more like comfy, warm shoes that are machine washable. I’ve had my current pair for 2 years, and had my last pair for 3. They still look good and hold up great. They are the best.

–Ralph Lauren Down Coat: $13 at after-season sale. This is the perfect everywhere coat. It looks good with every day jeans, and I’ve even worn it to church. Warm, machine washable, and has held up really well.

–Burt’s Bee’s Pomegranate lip balm: $3. The best lip balm on the planet. Period. I hate lipstick and sticky glosses. Burt’s Bees is all natural, non greasy, long lasting. It’s everything a lip balm should be.

–Dove Body Mist: $5. I have a problem with strong perfumes. I love the light, fresh scents of these body mists as a perfume alternative. It makes me feel pretty and fancy even though I’m really not.

–Levi Strauss Khaki Purse: $2 at thrift store. I had been searching for the perfect purse for ages. This one is just big enough to fit travel size wipes inside, along with my wallet. It has a pocket for keys, a pen, lip balm, cell phone, and business cards. I like things organized. It’s small and cute and a little funky and I love it.

Do you have to spend thousand and thousand of dollars to adequately care for a baby? I don’t think so. Naturally, it’s a personal choice. But I think if you’re going into debt for a stroller, you should rethink your priorities! I’ve spent absurdly little on baby gear, and I’ve never once heard my 3 kids complain. I’m comfortable with hand-me-downs, clearance sales, and store brands.
